Divorce
A smoother road ahead
Going through a divorce requires a couple to make long-term decisions, each of which has consequences for the entire family. When I advocate for you, you receive experienced counsel coupled with compassion and common sense to help you deal with the matters at hand as quickly and as stress-free as possible.
The majority of my cases are divorce-related:
Divorce
Texas is a no-fault state. That means your marriage can be legally dissolved in 60 days. However, if either of you contests the divorce, you can benefit from an experienced divorce lawyer to guide you through the process step by step.
Child custody
Texas courts uphold the best interests of the child in determining custody and visitation and take many factors into consideration. Joint custody is usually, but not always, rewarded.
Child support
Texas has guidelines for determining the amount of child support the non-custodial parent has to pay based on net income and the number of children involved. The Law Office of Eric L. Fredrickson, P.C. in Houston can help you seek a court order for child support, file a lawsuit for child support, and understand the state guidelines for calculating child support.
Interstate child support
Child support may become complicated when one spouse moves out of state. Legal guidance can help determine the best course of action in pursuing appropriate child support payments.
Alimony
Financial need, child responsibilities, and all sources of income are among the factors considered in determining spousal support. I can help you receive fair resolution whether you seek alimony or are subject to provide it.
Property division
Texas is a community property state, meaning each spouse jointly owns the marital assets. I can help you understand which of your assets qualify and assist you in developing a property division settlement out of court. If you and your spouse do not agree on division of your assets, I am prepared to take your case to court to protect your rights.
Modifications
After a divorce, the custodial or non-custodial parent may experience a significant change in financial circumstances, may need to relocate, or may have another reason to seek modification of a divorce decree or court-ordered custody, support, or visitation. Modifications must be pursued through the court system in order to be valid.
Enforcement and contempt
If you face a situation where support, custody, or visitation agreements are not honored, I can help ensure those agreements are enforced. And if one of the parties in the divorce does not honor the court order, the court can find that party in contempt and that person may be jailed.
